Welcome to Amisi. These Terms of Service ("Terms") govern your access to and use of the Amisi platform, including our website, mobile applications, and AI image generation services (collectively, the "Service"). Please read these Terms carefully before using our Service.
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Amisi offers different subscription tiers with varying features and limitations. The specific features, credits, and limitations of each tier are described on our pricing page. We reserve the right to modify the offerings and pricing of these tiers at any time.
Our Service operates on a credit-based system for AI image generation:
Credits are allocated based on your subscription tier and are refreshed on your billing cycle. Free tier users receive a one-time allocation of credits.
Different operations consume different amounts of credits. The credit cost for each operation is displayed before you confirm the operation.
Unused credits may roll over to the next billing cycle, subject to maximum rollover limits as specified for your subscription tier.
You may purchase additional credits at any time. Purchased credits do not expire but are used after your subscription credits.
We reserve the right to adjust the credit system, including credit costs for operations and rollover policies, with reasonable notice to users.
Our Service allows you to input text prompts and generate AI images. You retain ownership of your text prompts, but you acknowledge that similar prompts may generate similar results for different users.
Subject to your compliance with these Terms and payment of applicable fees, you own the images generated through our Service. However, we retain the right to use generated images in an anonymized form to improve our AI models.
You grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your text prompts and generated images solely for the purposes of:

Generate content that violates any applicable law or regulation.
Create content that promotes violence, discrimination, or hatred.
Generate sexually explicit or pornographic images.
Create misleading content intended to deceive others.
Generate content that infringes on others' intellectual property rights.
Attempt to manipulate or overload our systems or circumvent any limitations.
We reserve the right to review content generated through our Service and to remove any content that violates these Terms. Repeated violations may result in account suspension or termination.
Subscription fees are billed in advance on a monthly or annual basis, depending on your selected billing cycle. You authorize us to charge your payment method for all fees incurred.
We may change our subscription fees at any time. We will provide notice of any price change at least 30 days before it takes effect. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the modified fee.
Payments are non-refundable, except as required by law or as explicitly stated in these Terms. If you cancel your subscription, you will continue to have access to the Service until the end of your current billing period.
You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of your current billing period.
The Service and its original content, features, and functionality are owned by Amisi and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Our name, logo, software, algorithms, user interface, and AI models are our exclusive property. Nothing in these Terms grants you a right or license to use any of our trademarks, logos, or other intellectual property except as expressly set forth herein.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMISI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL AMISI'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
AMISI DOES NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.
You agree to defend, indemnify, and hold harmless Amisi and its licensees, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be exclusively brought in the federal or state courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
